Plan Change 39 to the District Plan (Rural Volume) proposes to modify and update the tree planting trees provisions of the District Plan by removing tree shading rules entirely from the Part C Rural Rules – Tree Planting and Removal of Protected Trees from the rural volume of the District Plan.

The relevant overarching objectives and policies in Part B2 Physical Resources and Part B3 Peoples Health, Safety and Values will be retained.

A report will be published and a Council hearing will be arranged to consider all submissions, after which the Council will decide whether to withdraw, retain or modify the plan change.

Any submitter who is not satisfied with the Council’s decision may then appeal to the Environment Court.

Notification

On 26 February 2014 Council resolved to notify Plan Change 39 – Tree Shading.
Submissions closed at 5.00pm on 22 July 2014.

A Council hearing will then be arranged to consider all submissions, after which, the Council will decide whether to reject or approve the plan change.

Any submitter who is not satisfied with the Council’s decision may then appeal to the Environment Court.
