About the private plan change

On 7 August 2019 Rupert and Catherine Wright lodged a private plan change request with the Council. The request seeks a change to the Operative Selwyn District Plan by rezoning approximately 30 hectares of current rural land in Darfield to residential and industrial land. This would enable approximately 35 residential sites and an industrial zone.

Update 13 October 2021

The period for lodging appeals on Private Plan Change 61 ended on Tuesday 5 October 2021, and no appeals were received. The provisions of Private Plan Change 61 will therefore become fully operative on 20 October 2021.

Update 25 August 2021

Council's decision to accept the recommendation of the Commissioner, will be publicly notified on 25 August 2021, which provides an opportunity for submitters on Plan Change 61 to lodge an appeal. A copy of the public notice is below.

Update 11 August 2021   

At its meeting on 11 August 2021, the Council considered the recommendation of the Commissioner in respect of the plan change request. Council resolved at this meeting to accept the Commissioner's recommendation on Plan Change 61 as its formal decision. This will be notified in due course.

Update 5 August 2021

Update 19 April 2021

A hearing in relation to this plan change request was held at the Darfield Library and Service Centre on 16 April 2021. The Commissioner will now consider the request and make a recommendation to Council whether to accept, accept in part, or reject the request.

Update 5 March 2021

A Commissioner has been appointed and a hearing is to be held at Darfield Recreation and Community Centre, North Terrace, Darfield on 16 April at 9am, to consider the application.

The Commissioner's Hearing Minute [PDF, 148 KB] circulated on 5 March 2021 requested that expert evidence be pre-circulated at set times. Council is required to make its s42A report available on 23 March 2021. The applicant’s expert evidence is to be made available on 30 March 2021 and the submitter's expert evidence is required to follow on 8 April 2021.

The Officer's report is currently being prepared and will be available to view on 23 March 2021.

Update 19 February 2021

Due to Council having recently received further information from the Applicant on Plan change request 61, including a change to the Outline Development Plan, the Hearings Commissioner, Mr Dean Chrystal, has agreed to Council’s request to delay the hearing. Council will arrange for a new date to be set at a time in April, after Easter.

Update 12 February 2021

The applicant has provided an amended outline development plan and letter, which seeks an amendment to be made to the plan change request. Council will respond to the amended outline development plan and letter through the Staff Recommendations Report to the Hearings Commissioner, which will be published on 19 February 2021.

The period for further submissions closed on Wednesday 16 September 2020. No further submissions were received.

The next steps will be to determine if any further information is required in response to the matters raised in submissions, and to schedule a hearing.

Further submissions may only be lodged by any person representing a relevant aspect of the public interest or that has an interest in the plan change greater than the interest the public has, or by the local authority itself.

Further submissions must be limited to matters either in support of or in opposition to an original submission made on Plan Change 61. This must be in writing and in accordance with Form 6, which is available below or from any Council Service Centre. Further submissions must be served on Selwyn District Council and a copy must be provided to the person who made the original submission no later than 5 working days after a further submission is provided to Council.
