About the private plan change

On 17 November 2020 Rolleston West Residential Limited lodged a private plan change request with the Council. The request seeks a change to the Operative Selwyn District Plan by rezoning approximately 160 hectares of land in two separate locations on Dunns Crossing Road, Rolleston. This would enable approximately 2100 residential sites and two commercial areas.

Variation 1 to PC73

On 20 August 2022, Council notified Variation 1 to Plan Change 73 to the Operative District Plan. This variation is required by the Government’s new building intensification rules to allow for more housing and at greater heights, in relevant residential areas.

Council notified its decision on Variation 1 to Plan Change 73 on 19 August 2023. Those parts of the private plan change that were altered by the Council’s decision to accept the recommendations of the Independent Hearings Panel, become operative on 28 August 2023.

Update 24 May 2022

The period for the lodgment of any appeal closed 23rd May 2022. The Decision of Council has been appealed to the Environment Court.

Update 3 May 2022

On 29th April 2022, the plan change applicant lodged an appeal against the decision of Council to decline the request.

The period for the lodgement of any appeal is open until 23rd May 2022. As such, there is time for other parties to consider if they wish to appeal the decision, or be joined as a party to the applicant’s appeal.

Update 6 April 2022

At its meeting on 23 March 2022, the Council considered the recommendation of the Commissioner in respect of the plan change request. Council resolved at this meeting to accept the Commissioner's recommendation on Plan Change 73 as its formal decision, and decline the plan change request. This decision will be publicly notified on 6 April 2022, providing an opportunity for parties involved in Plan Change 73 to lodge an appeal against the decision. Update 24 September 2021

As Councils’ urban design expert is unable to attend the hearing for PC73, a pre-hearing conference was held on Thursday 23 September 2021 between the applicant and the Council’s urban design experts. Following this conferencing, a joint witness statement has been prepared to identify the points on which the experts agree and/or disagree in relation to urban design and landscape effects associated with the plan change.

Update 19 August 2021

A Commissioner has been appointed and a hearing is to be held at the Selwyn Health Hub, Norman Kirk Drive, Rolleston on 28 and 29 September 2021, with 30 September 2021 a standby date (if a third day is needed) to consider the application.

The Commissioner's Hearing Minute circulated on 19 August 2021 requested that expert evidence be pre-circulated at set times.

The Officer's report is currently being prepared and will be available to view on 6 September 2021.

Update 5 August 2021

The period for further submissions on the New Zealand Defence Force (NZDF) submission closed on Wednesday 4 August 2021. No further submissions were received.

The next steps will be to determine if any further information is required in response to the matters raised in submissions, and to schedule a hearing.

Update 21 July 2021 – Re-notification of Summary of Submissions

Council notified the summary of submissions and called for further submissions on 16 June 2021, with the period for further submissions closing on 30 June 2021. Following this, Council received a late submission from the New Zealand Defence Force (NZDF). With the agreement of the private plan change proponent, the Council is re-notifying the summary to include the NZDF submission.

The NZDF submission [PDF, 1045 KB] has been included in the summary and is open for further submissions until 5pm, Wednesday 4 August 2021. The period for further submissions was publicly notified in the Selwyn Times 2 July 2021.
