Selwyn District Council – Standard Membership Terms and Conditions 
From 1 July 2026 

We are glad that you are taking the time to read these terms and conditions (Terms). These Terms, together with the information on the Selwyn Recreation Portal (Portal), set out the legal terms on which you may use our facilities. By using our facilities, you agree to be bound by these Terms.

1. General

1.1 In these Terms, 'you' means the person named in the Portal, and 'we', 'us' or 'our' means the Selwyn District Council.

2. Facilities and Activities

2.1 We agree to make available to you the sports and recreational facilities we operate, and the activities we offer (including group fitness, aqua fitness, and adult and children’s recreational classes), in accordance with these Terms and as set out on the Portal.

3. Hours and Access

3.1 Our facilities are available during the opening hours published on the Portal. Access is on a first‑come, first‑served basis.

3.2 We may close all or part of a facility, including on statutory holidays, for special events and for maintenance work. You are not entitled to any refund of fees for such closures.

3.3 We will provide updates about facility hours or changes to access through one or more of the following channels:

(a)emails,
(b)text messages,
(c)the facility’s notice boards,
(d)the Portal, and/or
(e)our social media pages.

3.4 Certain equipment or activities may be unavailable from time to time, and some activities may be offered only periodically or seasonally.

3.5 We may restrict access to certain facilities or activities for health and safety, operational, or capacity reasons.

3.6 We are not liable for any closures, restrictions, or unavailability described in this section, except as required under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

4. Memberships and Passes

4.1 When creating a membership or purchasing a pass, you confirm that:

(a) you are at least 18 years of age and legally able to enter into contracts, or, if you are aged 16 to 17 years, you have written consent from a parent or guardian;
(b) you will use the facilities lawfully and comply with these Terms at all times;
(c) all information you provide (e.g., name, phone number(s), postal address, email address, emergency contact details) is true, accurate, current and complete, and you will keep it updated;
(d) if you have a Selwyn Recreation account (Account) with us, you will safeguard your login details and are responsible for any use of your Account by you or anyone else; and
(e)you are responsible for paying all amounts due under your membership or pass.

5. Memberships

5.1 To create a membership, you must follow either:

(a) the account creation process on the Portal, and/or
(b) the instructions provided by our staff at the facility.

5.2 Access to facilities varies depending on the type of membership you hold.

5.3Memberships may be:

(a) single facility memberships, which may be limited to specific activities within that facility; or
(b) multi‑facility memberships.

Details of the facilities included in each membership type are available on the Portal.

5.4 Memberships may be one of the following types:

(a) Open Term - your membership will continue until we or you end it in accordance with these Terms. You must pay your membership fees in advance by recurring payment at the frequency set out on the Portal.
(b) Minimum Term - your membership will have a minimum term, as specified on the Portal. After the end of the minimum term, your membership will continue until we or you end it in accordance with these Terms. You must pay your membership fees in advance by recurring payment at the frequency set out on the Portal.
(c) Fixed Term - your membership will continue for a fixed term, as specified on the Portal. At the end of the fixed term, your membership will automatically expire. Membership fees must be paid in advance at the frequency set out on the Portal.

6. Flexi (Concession) Pass, and Summer Pool Season Pass

6.1 You may purchase a flexi (concession) pass and a summer pool season pass:

(a) through the Portal, or
(b) by following the instructions of our staff at the relevant facility.

6.2 Flexi (concession) passes do not expire. A flexi pass may be used by you or by any person to whom you give the pass. The pass must be paid for in full at the time of purchase.

6.3 A summer pool season pass expires at the end of the relevant pool season. It may be used at Darfield and Southbridge pools by any person who is physically holding the pass card, which must be scanned on entry. The card holder may bring guests into the pool.

6.4 The pass holder is responsible for ensuring that any person using the pass, including any guest admitted with it, complies with these Terms. Failure to do so is a breach of these Terms.

7. Commencement and cancellation

7.1 Your membership or pass will start on the date of the first payment (or any other start date agreed with us) and will continue until the end of its fixed term (for Fixed Term memberships) or until cancelled or terminated under these Terms.

7.2 Open Term memberships - You may cancel an Open Term membership by giving 30 days’ notice at the facility. Cancellation takes effect from the next payment due date after the 30 day notice period ends. No administration or cancellation fee will be charged.

7.3 Minimum Term memberships - After the minimum term ends, your membership continues as an Open Term membership and may be cancelled under paragraph 7.2.

7.4 Cooling-off period - You may cancel any membership within five days of joining by making a request to our staff. If you do so, you must pay for the days during which you had access to our facilities, at our standard daily rate and any goods received when joining. No administration or cancellation fee will apply.

7.5 Free trial (Open Term all‑access memberships) - If you have not held a membership with us within the past 12 months, you are eligible for a two‑week free trial for an Open Term all‑access membership. You may cancel the membership at any time during the free trial by requesting cancellation from our staff. No administration or cancellation fee will apply.

7.6 Medical cancellation - You may cancel any membership if you have a diagnosed illness that prevents you from using the facilities. We may require reasonable evidence to support your request. No administration or cancellation fee will apply.

7.7 Changes to these Terms - If we make changes to these Terms that, in our reasonable opinion, adversely affect you, you may cancel your membership by giving 30 days’ notice at the facility. No administration or cancellation fee will apply.

8. Activities

8.1 We offer activities at some of our facilities, as described on the Portal.

8.2 You can book activities through the Portal or directly at the facility.

9. Cancellation of activities by us

9.1 If we cancel an activity after you have booked it, we will:

(a)notify you by email or text message; and
(b)provide a credit or refund as set out in clauses 9.2 and 9.3.

9.2 If you purchased the activity at the facility, you must provide your receipt to request either:

(a) a credit to purchase another activity; or
(b) a cash refund as set out under clause 12.

9.3 If you purchased the activity through the Portal, a credit will be applied automatically to your account.

10. Cancellation of activities by you

10.1 If you cancel an activity at least 24 hours before its start time, you will receive a refund as set out in clauses 10.2 and 10.3.

10.2 If you purchased the activity at the facility, you must provide your receipt to request either:

(a)a credit to purchase another activity; or
(b)a cash refund as set out under clause 12.

10.3 If you purchased the activity through the Portal, a credit will be applied automatically to your account.

10.4 If you cancel an activity within 24 hours of its start time, we may charge you the full activity price, at our discretion.

11.Non-attendance

11.1 If you book an activity and do not attend it, and you have not cancelled in advance, we may charge you the casual activity price or deduct a visit from any concession pass used to book the activity.

12. Cash refunds

12.1 Our staff may provide cash refunds for amounts under $100 only where the original purchase was paid for in cash and provided the refund request is made on the same day as the original purchase. If the request is made after the day of purchase, we may issue a credit instead of a cash refund due to end-of-day cash handling requirements. For refunds of $100 or more, you may be required to complete a refund application form. We aim to process applications within ten (10) business days.

13. Minimum age to access gyms and group fitness classes at the facilities

13.1 For health and safety reasons, the minimum age requirements for access to gyms and group fitness classes are:

(a) 12 years old for group fitness classes at pool facilities;
(b) 14 years old for group fitness classes at other facilities; and
(c) 16 years old to sign up for a membership (with a parent/guardian co-signing).

13.2 Additional age restrictions may apply to certain equipment or classes.

14. Membership transfers

14.1 You cannot transfer your membership to another person.

15. Suspensions of membership

15.1 You may suspend your membership if its term is 12 months or longer, and the membership has not been cancelled.

15.2 Subject to clause 7 (Commencement and Cancellation), you may suspend your membership multiple times per year for a minimum period of 14 days and a maximum period of 56 days per calendar year, free of charge, by giving us notice via the Portal or at the facility.

15.3 You cannot suspend your membership once you have given notice to cancel it or during any required notice period. Any suspension request received after notice of cancellation will not be accepted.

16. Privacy

16.1 We are committed to protecting the privacy, confidentiality, and security of personal information entrusted to us. Our current Privacy Policy, available on the Portal, forms part of these Terms. We use your personal information to operate the facilities (including administering your account) and, with your consent, to market our facilities and activities to you. We may take general photographs or videos within the facilities. If you appear incidentally in such material, you agree that we may use it for promotional purposes and that you have no rights in that material. You release us and our contractors from any claims relating to its future use.

17. Medical

17.1 You must:

(a)ensure that you are fit and healthy to undertake your chosen activities; and
(b)consult your doctor if you have any health conditions that may affect your ability to participate safely.

18. Selwyn Recreation Card

18.1 We will give you a Selwyn Recreation Card (Card) when you create a membership.

18.2 Your Card is for personal use only. You must present it on entry to the facility and when requested by our staff.

18.3 Unless your membership type allows otherwise, we may suspend or terminate your membership if your Card is used by another person or if you access the facility without using your Card. We may issue a warning for a first breach.

18.4 You must notify us immediately if your Card is lost or damaged. A replacement fee applies, as set out on the Portal.

19. Conduct

19.1 You must comply with all rules displayed at our facilities, on the Portal and the instructions of our staff, including:

(a) use equipment and facilities safely and appropriately (including wearing suitable footwear);
(b) be courteous, considerate and respectful of our staff, other members and members of the public using the facilities. Unlawful, disruptive, dangerous or offensive actions will not be tolerated;
(c) maintain appropriate standards of dress and hygiene;
(d) not undertake any unauthorised commercial activity;
(e) not engage in illegal behaviour; and
(f) comply with all our health and safety requirements, including any instructions or directions from our staff.

19.2 We may require you (and any guests) to leave the facility immediately if you engage in any behaviour that we consider is dangerous, offensive, unlawful, disruptive, or does not comply with health and safety requirements, whether documented or not.

20. Independent Specialists

20.1 Independent personal trainers, coaches, physiotherapists and other consultants providing services at the facilities are not our employees or agents. Any arrangement you enter into with them is solely between you and the specialist.

20.2 You may only use the services of specialists who have written permission from the facility manager to operate within the facilities.

21. Fees

21.1 You must pay all applicable fees, charges, and GST, as applicable, for your membership. Fees, including administration fees, are published on the Portal.

21.2 You are not entitled to a refund if you choose not to use your membership.

21.3 Membership fees do not include food, beverages, special classes, or services provided by independent specialists.

22. Changes to fees

22.1 If we change our fees, we will give you 30 days’ prior notice by email and by posting notices at the facilities.

22.2 If you do not agree to the fee change, you may cancel your membership as set out in Section 7 before the change takes effect. No cancellation or administration fee will apply.

23. Recurring Payments

23.1 If you choose to pay membership fees by recurring payments, this section applies.

23.2 Recurring payments may be administered by us or by a third party appointed by us (Third Party).

23.3 If a recurring payment fails (for example, due to insufficient funds or a change in card details), we or the Third Party will notify you and may charge an administration fee.

23.4 If recurring payments are cancelled, or if two consecutive payments fail, we may terminate your membership by giving written notice.

23.5 After one missed payment, we may suspend your membership until a new payment plan is in place. To reinstate your membership or end a suspension, you must pay all outstanding amounts and any joining or administration fees.

23.6 You must submit all required recurring payment forms before your membership start date.

23.7 If your payment date falls on a public holiday, payment may be processed on the next working day.

24. Termination by Us

24.1 We may terminate your membership immediately if you materially breach any of these Terms. You are not entitled to a refund in that case.

24.2 If your membership is terminated for non‑payment, your account may be referred to a debt collection agency. Recovery costs may be added to your outstanding balance.

25. Liability

25.1 You use the facilities at your own risk and are responsible for your own property. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. We are not liable for any loss, damage, or injury related to your use of the facilities, except to the extent caused by our negligence.

To the maximum extent permitted by law, our liability to you is limited to the total membership fees paid by you in any 12‑month period.

25.2 Personal injury in New Zealand is covered by the Accident Compensation Act 2001.

25.3 You indemnify us for all losses, costs and expenses arising from your unlawful, negligent, reckless, or dishonest acts or omissions. This indemnity survives termination of these Terms.

26. Variations to these Terms

26.1 We may amend these Terms from time to time. We will notify you of changes by email and by posting notices at the facilities.

27. Assignment

27.1 We may assign or transfer our rights or obligations under these Terms by giving you written notice.
