Selling without code compliance

You can sell your home without a code compliance certificate. This may however

  • affect how your sale and purchase agreement is worded, and
  • can potentially impact insurance and/or the final builder payment by the bank.

Older buildings with code compliance older than two years

You can still apply for a code compliance certificate if your building is older than two years and has no code compliance certificate.

Your application will be assessed to make sure we are satisfied on reasonable grounds that the building work has

  • been constructed to comply with the building code in place at the time of construction, and
  • has continued to meet the building code requirements (including maintenance).

Certificate of acceptance

Where you can't get a code compliance certificate for your building you can apply for a certificate of acceptance (COA).
