About the private plan change

On 29 October 2020 Rolleston Industrial Developments Limited lodged a private plan change request with the Council. The request seeks a change to the Operative Selwyn District Plan by rezoning approximately 190 hectares of current rural land in Lincoln to residential land. This would enable approximately 2000 residential sites and a small commercial zone.

Variation 1 to PC69

On 20 August 2022, Council notified Variation 1 to Plan Change 69 to the Operative District Plan. This variation is required by the Government’s new building intensification rules to allow for more housing and at greater heights, in relevant residential areas.

Council notified its decision on Variation 1 to Plan Change 69 on 19 August 2023. Those parts of the private plan change that were altered by the Council’s decision to accept the recommendations of the Independent Hearings Panel, become operative on 28 August 2023.

Frequently asked questions

What is Private Plan Change 69 (PC69) about?

It’s a request made to the Council by Rolleston Industrial Developments Limited to rezone in south of Lincoln 190 hectares of rural land for residential development. If the rezoning is approved, it would enable close to 1,700 residential sites and three small commercial zones.

Why is the Council processing PC69?

It’s something we are required to do as a result of new national rules that direct councils to enable more land for urban development to meet housing needs. Before these rules were introduced the Council wasn’t planning to rezone this land.

Since 2020 when the National Policy Statement On Urban Development (NPS-UD) was introduced the Council has received an unprecedented number of private plan change requests for rezoning land across the district – in total 16 which, if all approved, would enable further 10,000 residential sites.

Why has the Council appointed a commissioner to review the request in the first place?

Independent commissioners have the expertise to hear and consider the submissions, especially given this is a highly complex process. Also given the sheer number of private plan change applications, it ensures a fair and consistent process.

What is the Commissioner’s role?

The Council has delegated the authority to the independent commissioner to:

  • hear directly and in person the submitters,
  • review and consider all of the evidence produced, and
  • make a recommendation to the Council.

What information does the Commissioner consider when reviewing a private plan change request?

Submissions, evidence and all legislative requirements.

What input has the public had?

We ran public consultation at two stages of the process. We received 255 submissions and seven further submissions. Also 66 parties gave evidence at the hearings.

What impact have the submissions had, if any, on the application?

In response to Council and submitters concerns the Commissioner requested changes to PC69 including reduction in number of residential sites, more commercial land that can cater for community and educational facilities, and changes to address traffic volumes.

Who makes the final decision on whether or not to approve PC69?

The Commissioner, who has seen all the evidence and submissions, makes a recommendation to Council. But only Council can make the final decision.

Could the Council have rejected commissioner’s recommendation?

Theoretically it could have but this is not an accepted good practice. This is because the Council wasn't involved in the hearings, didn't consider the evidence and didn't review submissions.

Also going against the recommendation would have likely exposed the Council to a legal challenge by applicants.

Could the Council have delayed the decision, given the other planning processes underway which could have affected the decision?

No, delaying would have been considered unjustified, given that the other processes are going to take at least another year.

Also we are required to make a decision on a private plan change request within two years of the notification. PC69 was notified on 28 April in 2021.

What happens now that the Council accepted the Commissioner's recommendation?

Council's decision needs to be publicly notified. Once that happens those who submitted during the public consultations and applicants, will have 30 working days to make an appeal to the Environment Court against the Council’s decision.

If an appeal is received the Environment Court would run its process which could involve mediation or holding hearings, and then make the final decision.

Update 8 August 2022

On 4 August 2022, Lincoln Voice Incorporated, as the successor to 13 individuals who made submissions or were part of joint submissions on the plan change, lodged an appeal  under Clause 14, Schedule 1 of the Resource Management Act 1991 against the decision of Council to approve the plan change request. The part of the decision that is being appealed against set out in the Notice of Appeal below.

Update 22 June 2022

At its meeting on 8 June 2022, the Council considered the recommendation of the Commissioner in respect of the plan change request. Council resolved at this meeting to accept the Commissioner's recommendation on Plan Change 69 as its formal decision, and approve the plan change request. This decision will be publicly notified on 22 June 2022, providing an opportunity for parties involved in Plan Change 69 to lodge an appeal against the decision. Update 3 May 2022

Council has received the Commissioner's draft recommendation [PDF, 1429 KB] in relation to PC69.

Having regard to the draft recommendation of the Commissioner to approve the plan change, Council staff advised the Commissioner that they had concerns in terms of administration of some of the components of the Outline Development Plan and provided the Commissioner with two alternative methodologies and requested that he consider these.

Accordingly, the Commissioner has issued Minute No. 6 [PDF, 301 KB], giving all parties the opportunity to comment on the most appropriate way to ensure that the outcomes sought by the ODP are achieved in a manner which is certain, workable and enforceable.

The Commissioner has advised that he will not consider any correspondence which seeks to readdress the merits or otherwise of PC69 or any other matters beyond the narrow issue addressed in this Minute.

Any comments addressing the specific matter addressed by Minute No. 6 are to be provided, in writing, no later than 5.00pm

Monday 9 May 2022.

Council will consider this recommendation at a forthcoming meeting of Council.

A Commissioner has been appointed and a hearing is to be held at the Tai Tapu Community Centre, 722 Old Tai Tapu Road, Tai Tapu from Monday 22 November 2021 to Friday 26 November 2021, to consider the application.

Update  12 May 2021 - Re-notification

Following the notification of Private Plan Change 69 (PC69) on Wednesday 28 April 2021, Selwyn District Council was made aware of a minor error in the public notice regarding the site area (notified as 186ha). As a consequence, the Council is re-notifing the request to avoid any issues that this error may cause to further processes, and has extended the period for submissions until 10 June 2021.

The Plan Change re-notification was publicly notified in the Selwyn Times newspaper on 12 May 2021.
